AGREEMENT- OFFER
General provisions
1.1 This Agreement is an official offer (public offer) of IE Deryabin Danila Alekseyevich, online store Daddy Dreads (hereinafter referred to as “Contractor”) for fully capable individuals (hereinafter referred to as “Customer”) who accept this offer, under the following conditions.
1.2 In accordance with p. 2 article 437 of the Russian Civil Code (Russian Civil Code) in case of acceptance of the conditions stated below and payment for the services the legal entity or the natural person who accepts this offer shall become a Customer (in accordance with p. 3 article 438 of the Russian Civil Code the offer acceptance is tantamount to concluding an Agreement upon conditions stated in the offer).
The moment of the Customer’s full and unconditional acceptance of the Contractor’s offer to conclude an Agreement of the offer (the offer acceptance) is the fact of the Customer’s confirmation of his willingness to pay for the service of the Contractor by pressing the “Pay” button on the website https://daddydread.com.
1.3. The text of this Agreement-Offer (hereinafter referred to as the “Agreement”) is located at: https://daddydread.com/privacy-policy/.
1.4 By accepting the Agreement in accordance with the procedure specified in paragraph. 1.3 of the Agreement, the Customer confirms that he reads, agrees, fully and unconditionally accepts all the terms of the Agreement as set forth in the text of the Agreement, including the annexes to the Agreement, which are an integral part thereof.
1.5 The Customer agrees that acceptance of the Agreement in the order specified in clause 1.2 of the Agreement is conclusion of the Agreement under the conditions set forth therein.
1.6 The Agreement cannot be withdrawn.
1.7 The Agreement shall not require sealing and/or signing by the Customer and Contractor (hereinafter referred to as Parties) and shall remain valid.
- Subject of the Agreement
2.1 Subject of this Agreement is paid provision of educational services by the Executor in accordance with the terms of this Agreement. 2.2.
2.2 Customer fully accepts the terms and conditions of the Agreement and pays the Provider’s services in accordance with the terms of this Agreement. 3.
Payment for Services
3.1. The cost of the services according to the Agreement shall be determined in accordance with the valid prices and is written on the website https://daddydread.com.
The cost of services can be changed by the Executor unilaterally. 3.3.
3.3 Methods of payment for the service are given when arranging the payment.
4 Intellectual property
4.1. All text information and pictures at https://daddydread.com are the property of the Executor. 5.
- Special conditions and responsibilities of the parties.
5.1 The Executor is responsible for the timeliness of the services provided if the Customer meets the established requirements and rules posted on the website https://daddydread.com.
5.2 The Executor shall be exempted from responsibility for violation of the Contract terms and conditions if such violation is caused by force majeure circumstances (force majeure), including: actions of public authorities, fire, flood, earthquake, other natural disasters, lack of electricity, strikes, civil unrest, riots, any other circumstances, not limited to those listed, which can affect the Executor’s performance of the Contract.
5.3 Contractor is not responsible for the quality of public communication channels or services that provide access to its services to the Customer.
Confidentiality and protection of personal information
6.1 Contractor is obliged not to disclose the information received from the Customer.
6.2 Disclosure of information in accordance with reasonable and applicable legal requirements is not considered as breach of obligation.
6.3 The Executor receives information about IP-address of the visitor of the site https://daddydread.com. This information is not used to identify the visitor.
6.4 The Executor is not responsible for the information provided by the Customer on the site https://daddydread.com in the publicly available form.
Procedure of consideration of claims and disputes
Claims of the Customer concerning services rendered are accepted by the Executor for reviewing by e-mail within 2 (two) days upon disputable situation occurrence. 7.2.
7.2 During consideration of disputable situations Executor has a right to request from the Customer all the documents, concerning the event in question. In case the Customer fails to submit the documents within 1 working day after the date of the claim, the claim shall not be considered by the Executor.
7.3 Provider and Customer, taking into account nature of rendered services, undertakes to apply pre-trial procedure of disputes settlement in case of disputes and disagreements, connected with rendering services. In case of impossibility to settle the dispute pretrially, the parties shall be entitled to apply to court.
Other terms and conditions
8.1 The Customer has all rights and authorities necessary for conclusion and execution of the Contract.
8.2 The Customer has the right to unilaterally refuse the services of the Contractor at any time. In case of unilateral refusal of services by the Contractor, the payment made shall not be returned, but can be transferred to another service.
8.3 Executor reserves the right to change or amend any of the terms of this Agreement at any time by publishing all the changes on its website.
8.4 The parties shall be guided by the current legislation of the Russian Federation on all issues not regulated by this Agreement.
8.5 A court ruling that any provision of this Agreement and Rules is invalid shall not invalidate the remaining provisions.
